  • Criminal laws are enacted by legislatures or derived from common law , enforced by the executive branch of government, and interpreted and applied in particular cases by the judicial branch . The Constitution empowers the three branches of government to perform their roles and guarantees citizens certain rights when they are accused, arrested, tried, and convicted of an offense against the government and the people represented by that government. Their crimes may be overt acts, such as robbery or murder, or omissions, such as failure to stop at a red traffic light or pay income taxes. [Source: The U.S. Constitution A to Z; Criminal Law]
