  • In apparent response to the terrorist attacks of 9/11, President George W. Bush created a secret Terrorist Surveillance Program (TSP) that allowed the National Security Agency (NSA) to implement warrantless wiretaps of individuals it suspected of making overseas phone calls or emails to individuals believed to be associated with the al Qaeda terrorist organization. The program and its constitutional legality, including whether it complies with Fourth Amendment protections, has been debated since the New York Times revealed the program in an article on December 16, 2005.
