- Both by statute and judicial precedents, vessels at sea and their occupants generally have diminished Fourth Amendment protections. Legal commentator Daniel Cullum has observed that in addition to decisions that recognize a “maritime exception” to the Fourth Amendment, such searches may be justified under the border search exception, the exigent circumstances doctrine, and the plain view doctrine.
