Definición

  • A third party may provide valid consent to a warrantless governmental search of another party's property, vehicle, or possessions if the consenting party has either actual or apparent authority to consent to the search—that is, if the consenting party's relationship to the item to be searched is such that a reasonable person would conclude that the party has authority. When individuals consent to a governmental search voluntarily and without coercion, they have waived their Fourth Amendment right to be free from unreasonable searches and seizures.
