  • Supreme Court cases dealing with the Sixth Amendment guarantee that all accused criminals have the right to legal assistance. “In all criminal prosecutions,” the Sixth Amendment states, “the accused shall enjoy the right … to have the assistance of counsel for his defense.” Nevertheless, throughout American history, only persons charged with federal crimes punishable by death have been guaranteed this right.
