  • A controlling precept of the Fourth Amendment is that neutral and detached magistrates serve as a barrier between law enforcement officials and the persons or places they wish to search. These magistrates in theory serve in part to ensure that overzealous law enforcement officials do not violate the Fourth Amendment rights of citizens.
