  • the legal test of mental illness that asserts that a person is not responsible for a crime if at the time of the crime the conduct was the result of mental disease or defect such that either the individual is incapable of appreciating the wrongfulness of his or her conduct, or he or she cannot conform his or her conduct to what is required by the law.
