Definition
- Although the U.S. Supreme Court has recognized that the Fourth Amendment extends to telephone conversations, the Court ruled in Bartnicki v. Vopper, 532 U.S. 514 (2001), that First Amendment freedoms of speech and press trumped an antiwiretapping law that was designed to protect privacy rights under the Fourth Amendment. In Bartnicki, an unknown person intercepted a private cellular telephone conversation between a chief union negotiator, Gloria Bartnicki, and a teachers' union president, Anthony Kane, concerning the conduct of and strategies for collective bargaining negotiations with the local school district.
