  • Ex Parte Burford, 7 U.S. (3 Cranch) 448 (1806), is one of the rare nineteenth-century cases in which the U.S. Supreme Court mentioned the warrants clause of the Fourth Amendment in invalidating an incarceration. John Atkins Burford had been committed to the Alexandria County jail in the District of Columbia after he failed to post four thousand dollars to ensure his good behavior for life—a fine that had been mandated by Jonah Thompson and other justices of the peace for the county.
